(the “Competition Privacy Notice”)

Welcome to Cemex Ventures España, S.L.U.’s (“Cemex Ventures”) privacy notice regarding the Construction Startup Competition 2024 (the “Competition”).

Cemex Ventures respects the privacy of all the individuals whose personal data is collected in the context of the Competition (the “Individuals” or “you”) and is committed to protecting their personal data. This privacy notice will inform you as to how your personal data is processed by Cemex Ventures.

This Competition Privacy Notice shall be read in conjunction with our general privacy policy that you can find at the following address https://www.cemexventures.com/privacy-policy/ (the “Privacy Policy”) and the Construction Startup Competition 2024 Terms & Conditions that can be accessed by clicking on the following link https://www.cemexventures.com/terms-and-conditions/ (the “Terms”).  Capitalized terms used but not defined in this Competition Privacy Notice shall have the meaning given to them in the Terms. The Competition is not intended for children and no data relating to them is knowingly collected.

For the purposes of the Terms and this Competition Privacy Notice, “Partners” mean:

  • Société Européenne des Produits Refractaires SAS, a company existing under the laws of France, having its registered address at 12 Place de l’Iris, 92400 Courbevoie (France), registered at the R.C.S Nanterre under the number 305 756 413;
  • LNRD SAS, a company existing under the laws of France, having its registered address at 1973 boulevard de la Défense, 92000 Nanterre (France), registered at the Nanterre trade and companies register under the number 814 234 142;
  • Ferrovial Corporación, S.A.U., a company existing under the laws of Spain, having its registered address at Calle Príncipe de Vergara, 135, 28002 Madrid, Spain, holder of Tax Identification Number A-85959484;
  • HILTI Corporation, a company existing under the laws of the Principality of Liechtenstein, having its registered address at Feldkircherstrasse 100 – FL 9494 Schaan – Principality of Liechtenstein, holder of Registration number FL-0001.011.557-0;
  • Dysruptek LLC, a company existing under the laws of Delaware, United States, having its registered address at 111 Riverside Ave, Jacksonville, FL 32202, holder of Registration number 6889833;

2. Purposes for which your data will be processed

Cemex Ventures will collect and process the Individuals’ personal data for the purposes set out in the Terms, the Privacy Policy and this Competition Privacy Notice. In particular:

  1. to comply with the agreement entered into between Cemex Ventures and the Participants when registering in the Competition governed by the Terms, the Privacy Policy and this Competition Privacy Notice (the “Agreement”);
  2. to manage Participants’ registration in the Competition;
  3. to manage Participants’ and Individuals’ participation in the Competition;
  4. to contact the Participants to evaluate the establishment of business relationships;
  5. to contact the Participants or the Individuals after the Competition to keep them updated on similar events (e.g. future editions of the Construction Startup Competition) or relevant news of the construction industry as well as to analyse the potential establishment of business relationships;
  6. for advertising, informative and promotional purposes regarding the Competition or related topics (e.g. top 2024 Construction technology startups);
  7. to live broadcasting the Pitch Day Event; and
  8. to comply with the collaboration agreement entered into by Cemex Ventures with the Partners (please see Section 12 of the Terms).

Please note that the personal data we collect is necessary for Cemex Ventures to be able to carry out the purposes set out in this Competition Privacy Notice and to comply with the relevant legal or regulatory obligations. Therefore, it is important that the personal data that you provide is accurate and current. If you do not provide the data requested or the data is not accurate or current, it might not be possible to fulfil the purposes described in this Competition Privacy Notice. In particular, it might not be possible to perform the Agreement and manage your participation or the participation of the Startup that you represent in the Competition.

 

3. Data collected

Cemex Ventures collects, uses, stores and transfers the personal data that you or the Participant provide when registering in the Competition and during the development of the Competition. This includes the Pitch Day Event Content (please see Section 4) and may include Individuals’ images or voice provided in introduction videos of the Startups when registering in the Competition. Participants are responsible for providing a copy of our Privacy Policy and this Competition Privacy Notice, and obtaining the corresponding consents (if necessary) from, the individuals whose personal data is shared with, or collected by, Cemex Ventures during the Competition so that Cemex Ventures is allowed to collect, use, store and transfer such personal data in the terms of this Competition Privacy Policy, the Privacy Policy and the Terms.

 

4. Recipients of your personal data

Cemex Ventures may transfer your personal data to third parties as set out in the Privacy Policy, the Terms and this Competition Privacy Notice. In particular:

  1. Cemex Ventures may share all the personal data provided by the Participants during the Competition and otherwise collected by Cemex Ventures in the context of the Competition (e.g. the Pitch Day Event Content) with any company within its group (as defined in article 42 of Royal Decree of 22 August 1885 approving the Commercial Code) for the purpose of organising and managing the Competition, complying with internal compliance rules, the applicable law and regulations, analysing any potential establishment of business relationships with the Participants, advertising and promoting the Competition and related topics (e.g. top 2024 Construction technology startups), and contacting the Participants for such purposes.
  2. Cemex Ventures may share all the personal data provided by the Participants during the Competition (in particular, the information provided in Phase 1 – Application of the Competition, which shall hereinafter be referred to as the “Startup Information”)) with the Partners as long as (i) they are obliged to keep all non-public information secret and confidential and (ii) they use such information only for the development of the Competition, to analyse potential business relationships with Participants (being expressly hereby authorized to directly contact the Participants for this purpose) and as otherwise provided in the Terms.
  3. Cemex Ventures is authorized to (1) (either directly or through a service provider) videotape, audiotape, photograph, record, edit or otherwise reproduce the Pitch Day Event as well as certain preparatory acts (including Participants’ representatives’ participation, image and voice) (the “Pitch Day Event Content”) for the purposes of (i) live broadcasting the Pitch Day Event and any other preparatory acts and (ii) issuing press releases, social media announcements and making any other internal or external communication related to the Pitch Day Event, the Competition (including for the purposes of promoting future editions of the Construction Startup Competition) or related topics (e.g. top 2024 Construction technology startups), and (2) share with the Partners the Pitch Day Event Content, for the same purposes abovementioned.
  4. The Partners are authorized to edit and reproduce the Pitch Day Event Content provided by Cemex Ventures for the purposes of issuing press releases, social media announcements and making any other internal or external communication related to the Pitch Day Event, the Competition (including for the purposes of promoting future editions of the Construction Startup Competition) or related topics (e.g. Construction technology startups).

The transfer of your personal data to the Partners is subject to the Privacy Policy and this Competition Privacy Notice. Partners shall also be data controllers as from receipt of your personal data and, as such, shall comply with the applicable national and international laws.

 

5. How long will we keep your data?

Personal data provided by the Participants will be retained as long as necessary to fulfil the purposes for which it was collected, and to comply with legal, accounting, or mandatory reporting requirements.

 

6. Legitimation for processing the data

The legal basis for the processing of your data is the performance of the Agreement, Cemex Ventures’ legitimate interest to promote its competitions and develop and manage its business, and/or the explicit consent given by the Individuals. You can withdraw your consent at any time by writing to Cemex Ventures España, S.L.U., Calle Hernández de Tejada, 1, 28027 Madrid, specifying “Data Protection”, or via the following email address: privacy_spain@cemex.com. You may be asked to provide additional information to confirm your identity.

Personal data may be processed using more than one lawful ground depending on the specific purpose for which such data is being used. Also, Cemex Ventures may process your information for other purposes that are compatible with the disclosed purposes if and where this is permitted by applicable law. You can contact Cemex Ventures if you need details about the specific legal ground relied on to process personal data.

 

7. Amendments to the Competition Privacy Notice

Cemex Ventures reserves the right to update this Competition Privacy Notice at any time. In such event, Cemex Ventures shall publish the amendments on its website.
